Yep, who’d thought, they’re gonna legalize pot and make nicotine juice illegal (unless you’re a tobacco company of course).
Topic, what topic were we discussing something here
Exactly…
lmao thats funny
Start here for the short version of the Deeming Regulations
http://www.vaporvanity.com/just-happened-fda-releases-vape-regulations/
So basically any imported goods for the manufacturing of Eliquids and use of eliquids will be banned? So I can not get Pg or Vg. What about the flavorings? They can technically be sold as candy ingredients can’t they? Nicotine, as much as I like it I could really care less if I was able to get that.
My point is the ingredients we use to produce eliquids are not solely for eliquids. Propylene is used is all sorts of things ranging from makeup and soaps and probably food. This country is going to hell in a hand bag.
It might take time but I’m really hoping this all falls apart and we can resume our passion.
Oh and I called my local chamber of commerice. They had no idea. I even called the fda and she was as helpful as a hemroid. I’ll be talking to the big vape shops near me and see what they know at least in this state, if there is any difference between the states. I don’t know
Flavorings, pg and vg all have other purposes that have nothing at all to do with vaping… liquid nicotine also has other purposes im sure you will always be able to get these things maybe just not from the sources you do now. My first use of the flavourings that we all use to mix was for use in homemade hard candy
Just fyi. The fda will regulate all states unfortunately.
Even if you google YouTube with the terms rda and vaping you will find a ton of stuff.
Plus all of those groups fighting for out right b5 seconds of searching will give you an overwhelming sad picture.
Jeff it’s rough out here now to do anything with an ejuice company. No one has mentioned that now you have to send your bottles off to a third party marketing group to have them tested to be sure they are child resistant. Each flavor that you make… Filled, sealed, ready to go… has to be sent to the company and tested by 100 children and 100 seniors. I understand this is a costly measure too! There is entirely too much to getting started in this industry at this point to get in the game. I think someone said it wisely earlier… You missed the boat! Sorry to be Debbie downer.
I agree with you in theory unless he’s in a rural area where he is servicing a great need…or he’s going to sell stuff like DYI non nicotine supplies?
I think it’s mostly the FDA certifications and taxation that are the issues? And then the Ohio thing… (I was born there) Regulatory Hades with booze, cigarettes and now vape stuff…
We have a guy up north that started his business very recently by making sure he built it upon what he believed would be the end game for liquid. He’s making house liquids for larger vape shops with the vape shops branding on label and he’s making a mint doing it.
They put Food Grade VG in everything, it’s a completely benign food product. Flavorings for candies will always be available.
I think I’m just going to lie low for a while. Keep selling to my friends. See what happens with the ban.
My next question is, which might have to go to another topic is, now since I have a business and tax id, do I have to charge sales tax and keep documentation in order to keep my tax id and stay tax exempt?
I have never heard of a Tax ID that expires for ANY reason however that is a question best answered by your home state’s sales tax entity. As far as you collecting sales tax, legally yes, however I suggest you not claim it on sales of EJuice. If you do your setting yourself up for some heavy fines from the FDA should you not follow FDA rules for a manufacturer of a tobacco product…
