A small victory for NY. The judge has my praise for understanding the difference between the two. But like the article said, the scramble to reclassify tobacco or vape to meet the needs of the people that want to squash vaping will probably follow this ruling.

“An electronic cigarette neither burns nor contains tobacco,” the court noted. “Instead, the use of such a device, which is commonly referred to as ‘vaping,’ involves the inhalation of vaporized e-cigarette liquid consisting of water, nicotine, a base of propylene glycol or vegetable glycerin and occasionally, flavoring.”

Note "…and occasionally, flavoring…
That explains the 300+ flavors in my stash
So there are still some judges in NY that can read and apply common sense. Good to know.
