Correct. That’s why “intent” isn’t strong enough it seems unless it was quite literally packaged along side of nicotine. I think we will definitely see more companies go this route once final deadline is in. And then we’ll see a court challenge if the FDA aims to regulate them as tobacco. Remember, there are many flavoring companies who are in vape shops, and they aren’t not subject to PMTA.
@Wayne_Walker is correct, and yes I do believe we will see a lot of one shots popping up, legal or not. If you are really worried on the legalities… there is Nothing in place atm as far as regs.
What I do recommend if you yourself are producing and manufacturing your One Shots:
A Good LLC especially for your One Shot business.
Ins to cover at least a hospital stay of a few months.
Business license expressly for your one shot business.
Keep both a lawyer and a CPA on hand.
Look at your local state’s laws and see what other specialty needs you will have to buy into.
Beyond that, a talent for mixing good flavors.
May I suggest keeping your eye on how things are panning out here in Australia too. The Government “war on vaping” here has definitely affected availability of flavours that they reckon MAY be used for vaping. Even legitimate candy and baking companies have been affected to some degree on what they can get flavour wise going by the news. Not sure if your government will try and follow the same pathway but who knows these days…
But of course it’s perfectly legal for every man/woman and their dogs to smoke themselves to death as long as they can afford to pay the exorbitant rates of tax.
Smoking combustible tobacco never killed anyone and school kids can’t obtain it so that makes perfect sense.
