Wtf does that even mean?! Are the “tobacco products” that they’re talking about e-liquids? How can they require nicotine free products to state that they are made from tobacco when they aren’t?? This whole thing is straight up bull shit.
The language has to cover everything derived from tobacco, so they aren’t necessarily referring to e-liquids in everything. And that’s a big problem. A lot of the requirements are too vague and don’t convey any understanding for what it is they’re trying to regulate because the paper-pushers who write this shit apparently can’t talk to the scientists who actually study it.
I also notice that they refer to “smoke” and not once “vapor”. Loophole? Our corporate backed government in action.

Hmm. If I am reading that correctly in the beginning the rules seem to be aimed at ejuice manufacturers using flavoring, and they want all your ingredients listed by brand. Basically, we want your recipes.
By the end of it the statements seem to be aimed at big tobacco. How many of us use “tobacco” in our ejuice? They are clearly referring to tobacco seperately from nicotine. Strange.
@LordVapor I’m starting to think that the FDA’s definition of “tobacco product” is, “anything we don’t like”, regardless of whether it has anything to do with tobacco or not.

Yep. There’s some pretty tortured logic there on the part of FDA: nicotine is derived from tobacco, therefore nicotine-containing e-liquid is a tobacco product, which is used in a vape device, making the vape device a tobacco product, therefore anything that goes into it - including nicotine-free e-liquid - is likewise a tobacco product. It’s like saying that a spoon is a narcotic-product just because some people use spoons to cook heroine. Are they next going to classify VG as a tobacco product? Well, say goodbye to toothpaste, mouthwash, hand lotion, hair conditioner, cake frosting, etc. etc.
It has been mentioned. But anything they can tax as a tobacco product they are going to to cut their losses. Wait and see. Cotton will go up in every form. The wire we use, whether supplied for jewelry or whatever will be more expensive. VG and PG will go up. They might even see vaping as a bigger money generator than cigarettes. Taxes from more sources. Sure people will be pissed. But blame it on the vaping community.
